Nestablish.com, Inc., (“Nestablish”) collects personally identifiable information (“PII”) and non-personally-identifiable information (“non-PII”). By law, Nestablish may choose how it shares PII and non-PII information, and consumers have the right to limit some but not all sharing. "Personally Identifiable Information"

What PII is collected, and how?

We may collect several types of PII from users that use the system, including names, social security numbers, addresses, phone numbers and email addresses, loan data, income data, and credit history and scores. We may ask our users to enter the PII, or we may obtain it from another source such as the homebuyer’s loan officer, a credit bureau, or a previously-prepared loan application form.

How does Nestablish use PII and non-PII?

We need to collect and share PII in order to provide our services to users, including preparing and transmitting loan documents and personalizing the user’s access to Nestablish’s website. We may also use PII to make appropriate service offerings to the user. We will share PII in response to court orders or legal investigations or to otherwise protect our users if necessary. We may use PII or non-PII to market our own products or services, or those of affiliated or non-affiliated companies, to users. We may use non-PII to perform statistical analysis of usage of our services, including demographic collection and trend analysis.

With whom may the information be shared?

A user’s PII may be shared with other Nestablish users who need the PII to complete the user’s requests. For example, we may share a homebuyer’s PII with the homebuyer’s loan officer and we may share a real estate agent’s PII with the homebuyer. We may share aggregated non-PII, including the demographics of our users, with third parties, including advertisers and vendors. We may share PII with other companies for marketing purposes, but will always offer our users the opportunity to prohibit sharing (“Opt-out”) such information with third parties.

How can sharing of information be limited?

Users cannot limit the sharing of PII within the Nestablish systems for the purposes of performing Nestablish’s services. Users may opt out of receiving unsolicited or other marketing information from us or our vendors, and may authorize or prohibit our sharing of PII with third parties, by responding to emails as instructed, or by contacting us at This email address is being protected from spambots. Users can also request to have PII deactivated or deleted, and we will not sell, transfer, or use that PII in any way after receiving such request in writing such as email, letter or fax.

How does Nestablish keep PII secure?

To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These include computer safeguards and secured files and buildings. PII is only accessible to a limited number of qualified employees who are given a password in order to gain access to the information. We audit our security systems and processes on a regular basis. PII is protected by encryption protocols, in place to protect information sent over the Internet. While we take commercially reasonable measures to maintain a secure site, electronic communications and databases are subject to errors, tampering and break-ins, and we cannot guarantee or warrant that such events will not take place and we cannot be liable to our users for any such occurrences.

What happens if the Privacy Policy Changes?

We will make the most current privacy policy available on the Nestablish website. Additionally, if changes to the privacy policy might cause disclosure of PII that a user has requested remain confidential, we will contact the user and allow the user to prevent such disclosure.
